Terms of Service

These terms govern access to and use of CheqIT by venues, their staff, and their guests.

1. Agreement

These Terms of Service form an agreement between Cheqit LLC (“CheqIT”, “we”) and the organization or individual using the service (“you”). By accessing our website, the CheqIT staff application, or the guest claim experience, you agree to these terms.

2. License to use the service

During an active subscription, CheqIT grants you a limited, non-exclusive, non-transferable right to access and use the service for your internal property check-in operations. You may not resell, sublicense, reverse engineer, or copy the service.

3. Venue responsibilities

If you operate a venue using CheqIT, you are responsible for the guest data collected through your check-in points, including obtaining any notices or consents required by law for taking guest photos, collecting phone numbers, and sending SMS messages. You are responsible for your staff accounts and for the accuracy of the information they enter.

4. Acceptable use

You agree not to use CheqIT to:

  • violate any law or the rights of others;
  • collect data unrelated to property check-in;
  • send unsolicited marketing messages to guests; or
  • interfere with, probe, or overload the service or its infrastructure.

5. Fees

Fees, subscription term, and included usage are set out in the order form or written quote agreed between you and CheqIT. Fees are payable as stated there and are non-refundable except where required by law.

6. Intellectual property

CheqIT and Cheqit LLC retain all rights, title, and interest in the service, including its software, interfaces, and branding. You retain all rights to your own data.

7. Disclaimer — no custody of property

The service is provided “as is” and “as available”, without warranties of any kind, express or implied. CheqIT is software that records and helps match property check-ins. CheqIT does not take custody, possession, or control of any coat, bag, luggage, or other item, and is not a bailee. Responsibility for items remains with the venue and its staff.

8. Limitation of liability

To the maximum extent permitted by law, CheqIT is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost or damaged property. CheqIT’s total aggregate liability arising out of or relating to the service is limited to the fees you paid to CheqIT in the twelve (12) months preceding the event giving rise to the claim.

9. Termination

Either party may terminate at the end of the then-current subscription term, or earlier if the other party materially breaches these terms and does not cure the breach within 30 days of notice. On termination, your right to use the service ends and we will delete or return your data as described in our Privacy Policy.

10. Changes to these terms

We may update these terms from time to time. Material changes will be reflected in the “last updated” date above and communicated to venue administrators. Continued use after an update means you accept the revised terms.
